Terms of Service

Last updated: October 27, 2026. These terms apply to the Cada mobile app and website. By creating an account or using Cada, you agree to them.

1. Who we are and what Cada is

Cada is owned and operated by ENOMARA INVESTMENTS LTD, a private limited company registered in Kenya (company number PVT-8Z1Z3D33), with its registered office at Eden Square, Sarit, Westlands, Nairobi (P.O. Box 568 - 00606, Sarit Centre; +254 701 007 079; [email protected]). Cada is an online marketplace operated in Kenya that connects people who want to buy or service vehicles with dealers and garages. Cada is a marketplace, not the seller of the vehicles or the provider of the garage services listed on it. Listings, prices, vehicle descriptions, and services are provided by dealers and garages, who are responsible for them. Any purchase or service contract is between you and that dealer or garage.

2. Your account

You must give accurate information, keep your login secure, and be old enough to enter a binding contract under Kenyan law. You are responsible for activity on your account. We may suspend or close accounts that break these terms, are used for fraud, or put other users at risk.

3. Listings, prices, and availability

Who may sell. You may list a vehicle only if you own it or hold the owner's written authority to sell it. When you list a vehicle for its owner, as a broker, agent or on behalf of family, you must give the owner's full name and upload their signed authority to sell. Cada checks it before the ad goes live and may ask for more documents, refuse the ad, or take it down. Private sellers confirm their identity with an ID check and show each vehicle's logbook.

Sellers are responsible for the accuracy of their listings, including price, condition, mileage, ownership, and whether a vehicle is available. Cada may show verification badges (for example KRA PIN, NTSA/TIMS, or odometer checks) where Cada has reviewed supporting information, but a badge is not a guarantee. Always inspect a vehicle, confirm ownership and documents, and verify a garage before you pay.

4. Reservations, deposits, and payments

What Cada collects. Cada takes payments by M-Pesa or card: deposits to reserve a car, garage jobs booked through Cada (collected on the garage's behalf), and fees for featuring a listing. One payment is at most KES 250,000. The balance of a car's price is arranged directly with the seller and is never paid through Cada.

Deposits. Cada sets the deposit from the car's price and shows it to you before you pay. Once your deposit is confirmed, the car is held for you for the time shown when you paid. A card checkout holds the car for 10 minutes; if it is not finished by then, the car is released. If the sale completes, the deposit counts toward the price. Where online payment is not available, a reservation is a request that the seller confirms, and no money is taken.

Refunds. Refunds are sent within 7 days of the decision, back to the card or M-Pesa number that paid. You get the full deposit back if the seller declines, the hold expires, or the car is no longer available. If you cancel the reservation yourself, the payment provider's fee for that payment is deducted (estimated at 3.5% when the exact fee is not known). If you cancel after an inspection or viewing, 20% of the deposit is also kept. You see the exact amount before you confirm the cancellation.

Garage jobs and featured listings. A garage job paid through Cada is paid for the quote the garage sent. A featured-listing fee is refunded only if the listing was no longer live when your payment arrived. Your rights under the Kenyan Consumer Protection Act are not affected.

Receipts. Every confirmed payment has a receipt in your account. Receipts are payment receipts, not KRA tax invoices. Payments marked “test mode” move no money.

Only pay through methods Cada or the dealer tells you to use. Be cautious of anyone who pressures you to pay off-platform before you have seen the vehicle and its documents. Cada will never ask for your M-Pesa PIN.

5. Garage bookings and test drives

Garage services are performed by the garage, not by Cada. Test drives are arranged with the dealer and are undertaken at your own risk: you must hold a valid driving licence and follow the dealer's and the law's requirements. Cada is not responsible for the quality of garage work or for anything that happens during a test drive.

6. Acceptable use

Do not post false, stolen, or illegal listings; do not harass other users; do not attempt to defraud, scrape, overload, or break the security of the service. You are responsible for the content you post and must have the right to post it.

7. Fees

Using Cada as a buyer is free unless stated otherwise. Sellers may pay a fee to feature a listing; the price and the number of days are shown before you pay. Dealers and garages may be charged for listings, placement, subscriptions, or commissions under a separate agreement. Any such fees, and applicable taxes, will be shown before you commit to them.

8. Liability

The service is provided on a reasonable-efforts basis. To the extent allowed by law, Cada is not liable for the acts of dealers, garages, or other users, for the condition or legality of any vehicle, or for indirect or consequential loss. Nothing in these terms limits liability that cannot be limited under Kenyan law, including your statutory consumer rights.

9. Data protection

We handle your personal data as described in our Privacy Policy, in line with the Kenya Data Protection Act, 2019.

10. Changes and governing law

We may update these terms; material changes will be posted here with a new date, and continued use means you accept them. These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute.
